Agreement to Terms

By accessing or using Programmica's all-in-one business management platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

Description of Service

Programmica provides an integrated business management platform including Customer Relationship Management (CRM), Point of Sale (POS), Enterprise Resource Planning (ERP), Inventory Management, Financial Management, and other business tools. We reserve the right to modify, suspend, or discontinue the service at any time without prior notice.

User Accounts

To use certain features of the service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use
  • Not share your account credentials with others

Acceptable Use Policy

You agree not to use the service for any unlawful purpose or in any way that could damage the service or impair anyone else's use of it. Specifically, you must not:

  • Use the service for fraudulent or deceptive purposes

Intellectual Property

The service and its original content, features, and functionality are owned by Programmica and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the service. By using the service, you grant Programmica a license to use, store, and process your data solely to provide the services to you.

Payment and Subscription

Certain features of the service may require payment of fees. You agree to:

  • Provide accurate billing information
  • Pay all fees and charges incurred under your account
  • Maintain valid payment method on file
  • Accept responsibility for all taxes applicable to your use

Subscription fees are non-refundable except as required by law. We reserve the right to change pricing at any time with 30 days' notice.

Free Trial

We offer a 30-day free trial of our service. No credit card is required to start the trial. At the end of the trial period, you may choose to subscribe to a paid plan or your account will be limited. Trial users have access to all features but may have limitations on data storage and user accounts.

Cancellation and Termination

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our sole discretion.

Data Protection and Privacy

Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the service, you consent to the collection and use of your information as described in our Privacy Policy.

Service Availability

We strive to maintain 99.9% uptime for our service. However, we cannot guarantee uninterrupted access. The service may be temporarily unavailable for maintenance, updates, or other reasons. We are not liable for any losses resulting from service interruptions.

Limitation of Liability

To the maximum extent permitted by law, Programmica shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Indemnification

You agree to indemnify and hold harmless Programmica and its affiliates, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of the service or violation of these terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of San Francisco, California.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the new terms on this page and updating the "Last Updated" date. Your continued use of the service after such modifications constitutes your acceptance of the new terms.

Severability
